Terms & Conditions

The terms that apply when you use our website or engage Studio Crest for websites, SEO, hosting, maintenance or marketing.

1. Agreement

These Terms & Conditions (“Terms”) govern your use of studiocrest.com and the services provided by Studio Crest (“we”, “us”, “our”). By using our website, submitting an enquiry, booking a consultation, accepting a quote, or paying an invoice, you agree to these Terms.

If a signed proposal, statement of work or separate written agreement applies to a project, that document prevails over these Terms where there is a direct conflict. Our Privacy Policy explains how we handle personal information.

2. Who we are

Studio Crest provides website design and development, Local SEO, hosting, maintenance and related digital marketing services for Australian businesses, based on the Gold Coast, Queensland.

3. Website use

You may use our website for lawful purposes only. You must not attempt to disrupt the site, scrape content at scale without permission, introduce malware, or misuse forms or booking tools. Package prices and package descriptions on the site are starting points and may change. Final scope and fees are confirmed in writing before work begins.

4. Quotes and scope

Quotes and proposals are based on the information you provide and the scope described. Unless stated otherwise, quotes are valid for 14 days. Changes to scope after acceptance — including extra pages, features, copywriting, photography, integrations or revision rounds beyond what was agreed — may require additional fees and revised timelines. We will confirm material changes with you before proceeding.

5. Fees and payment

Unless a proposal says otherwise:

  • Website and project fees are typically billed 50% to begin and 50% before launch or final handover
  • Ongoing services (such as SEO, advertising management, hosting or maintenance) are billed monthly or as otherwise agreed
  • Prices are in Australian dollars (AUD) and may be exclusive of GST unless stated
  • Invoices are payable by the due date shown. Late payment may pause work or delay launch

Deposit payments are non-refundable once work has commenced, except where required by Australian Consumer Law or otherwise agreed in writing.

6. Client responsibilities

To deliver on time, we need you to:

  • Provide accurate business information, branding assets, content and access credentials promptly
  • Confirm you own or have rights to use any materials you supply (logos, photos, copy, fonts, video)
  • Give feedback within agreed review windows
  • Ensure website content complies with advertising, industry and legal requirements that apply to your business

Delays in feedback, content or approvals may extend the timeline. We are not responsible for delays caused by third-party platforms, domain registrars, hosting providers outside our control, or late client inputs.

7. Revisions and acceptance

Projects include the revision rounds set out in your proposal. Extra revisions may be charged. Launch or final delivery constitutes acceptance of the work delivered under the agreed scope, subject to any agreed punch-list items and your rights under Australian Consumer Law.

8. Intellectual property

Until invoices for a project are paid in full, Studio Crest retains ownership of the design files, code and materials we create for that project. On full payment, you receive a licence to use the final delivered website and agreed assets for your business, unless otherwise stated in writing.

We may reuse general know-how, frameworks, libraries and non-client-specific components across projects. You keep ownership of materials you supply. We may showcase completed work in our portfolio and marketing unless you ask us in writing not to.

9. Hosting, maintenance and third-party services

Hosting, domain, plugin licences, stock assets, advertising spend and third-party subscriptions are separate from project build fees unless your proposal says they are included. Third-party terms apply to those services. We are not responsible for outages, policy changes or pricing changes by third-party providers.

SEO and advertising results depend on many factors outside our control (competition, algorithm changes, budget, industry, reviews). We do not guarantee rankings, traffic levels or a specific volume of leads.

10. Warranties and Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, our services are otherwise provided on a commercially reasonable basis and we do not warrant uninterrupted or error-free operation of websites or marketing systems.

11. Liability

To the maximum extent permitted by law, Studio Crest is not liable for indirect, incidental, special or consequential loss, including lost profits, lost revenue, lost data or business interruption. Where liability cannot be excluded, our aggregate liability related to a project or service is limited to the fees you paid us for that project or service in the 3 months before the claim arose, except where Australian Consumer Law requires otherwise.

12. Cancellation

Either party may cancel a project by written notice. If you cancel after work has started, you remain responsible for fees for work completed and committed third-party costs. Prepaid amounts for unused ongoing retainers may be handled as set out in your proposal or as we reasonably agree.

13. Confidentiality

Each party must keep confidential information received from the other reasonably secure and use it only for delivering or receiving the services, except where disclosure is required by law or the information is already public through no fault of the receiving party.

14. Governing law

These Terms are governed by the laws of Queensland, Australia. The courts of Queensland have non-exclusive jurisdiction.

15. Changes

We may update these Terms from time to time. The “Last updated” date will change when we do. For active projects, material changes that affect you will be communicated where reasonably practical. Continued use of our website or services after an update constitutes acceptance of the revised Terms.
